A “durable” power of attorney refers to a power of attorney which typically remains in effect until the death of the principal or until the document is revoked. (1)
How long do these documents remain valid? In Washington state, these documents last indefinitely, but we recommend that people review them every 3 to 5 years. It allows your aging parent to decide in advance who will make decisions on their behalf without removing any of their rights or transferring ownership of assets. They also get to decide how much control the agent has over the care of their assets.
